The same applies to Copilot, ChatGPT, and Gemini. For personal data protected by the nLPD (Swiss Federal Act on Data Protection), the solution is to use a hosting provider governed by Swiss law, such as Infomaniak.<\/p><\/aside>\n\n  <div class=\"intro-block\">\n    <p>\u00ab&quot;Why can&#039;t you use AWS?&quot; That&#039;s the question a prospect asked us last week. His reasoning was simple: AWS is reliable, scalable, and cheaper. Why complicate things?<\/p>\n    <p>Here is our answer.<\/p>\n  <\/div>\n  <div class=\"section\">\n    <h2>1. The real problem is not technical, it is legal<\/h2>\n    <p>When a Swiss SME entrusts its invoices, contracts, supplier data, or HR documents to an AI provider, it is entrusting them with sensitive data. Data protected by law. <strong>nLPD<\/strong> (new Federal Data Protection Act), which came into force on September 1, 2023.<\/p>\n    <p>The problem with AWS, Azure, or Google Cloud: your data passes through servers subject to <strong>American CLOUD Act<\/strong>. In practical terms, a US authority can demand access to your data, even if it is stored in Europe. Even if you are a small business in the canton of Vaud with 30 employees.<\/p>\n    <div class=\"key-message\">\n      <div class=\"key-message-label\">Good to know<\/div>\n      <p>Microsoft publishes a report every six months detailing the data access requests it receives from authorities worldwide. The very existence of this report speaks volumes: access is legally possible, and your Swiss SME is subject to the same legal scrutiny as all the others.<\/p>\n    <\/div>\n  <\/div>\n  <div class=\"section\">\n    <h2>2. &quot;But they have data centers in Switzerland now?&quot;\u00ab<\/h2>\n    <p>Yes, AWS, Azure, and Google Cloud have opened regions in Switzerland. But the physical location of the servers doesn&#039;t change the legal issue.<\/p>\n    <p>The CLOUD Act applies to any company incorporated under US law, regardless of where its servers are located. An Azure data center in Zurich remains subject to US law.<\/p>\n    <div class=\"highlight-text\">\n      <div class=\"ht-label\">What matters<\/div>\n      <p>It&#039;s not where your data is located that matters\u2014it&#039;s the legal entity that controls it. A server in Switzerland operated by an American company does not protect your data from the CLOUD Act.<\/p>\n    <\/div>\n  <\/div>\n  <div class=\"section\">\n    <h2>3. What the nLPD says \u2014 and the sanctions<\/h2>\n    <p>The new Swiss Data Protection Act (nLPD) imposes strict requirements regarding the transfer of personal data to countries that do not guarantee an adequate level of protection.<\/p>\n    <p>Since September 15, 2024, the Federal Council has recognized an adequate level of data protection only for US companies certified under the Swiss-US Data Privacy Framework. This recognition facilitates data transfers; it does not exempt these companies from the CLOUD Act.<\/p>\n    <div class=\"key-message\">\n      <div class=\"key-message-label\">Sanctions<\/div>\n      <p>Violations of the nLPD can result in fines of up to CHF 250,000 \u2014 and these fines target the responsible individuals, not just the company.<\/p>\n    <\/div>\n  <\/div>\n  <div class=\"section\">\n    <h2>4. The CLOUD Act, in concrete terms<\/h2>\n    <p>The Clarifying Lawful Overseas Use of Data Act (CLOUD Act), adopted in 2018, allows US authorities to compel any US-registered company to provide data stored on its servers, wherever they are in the world.<\/p>\n    <p>This means that if your AI provider uses AWS, Azure, or Google Cloud infrastructure, your billing data, contracts, and HR documents could theoretically be accessible to US authorities \u2014 without your knowledge.<\/p>\n    <div class=\"highlight-text\">\n      <div class=\"ht-label\">Critical point<\/div>\n      <p>Unlike the European GDPR, the CLOUD Act does not require notification to the data subject. Access can be completely opaque.<\/p>\n    <\/div>\n  <\/div>\n  <div class=\"section\">\n    <h2>5. Copilot, ChatGPT, Gemini \u2014 same problem<\/h2>\n    <p>It&#039;s not just a matter of cloud infrastructure. The most popular AI tools \u2014 Microsoft Copilot, OpenAI ChatGPT, Google Gemini \u2014 are all operated by US companies subject to the CLOUD Act.<\/p>\n    <p>Every prompt you send, every document you analyze with these tools, passes through servers controlled by entities governed by US law. Even if your instance is &quot;dedicated&quot; or &quot;European&quot;.<\/p>\n  <\/div>\n  <div class=\"section\">\n    <h2>6. The Swiss alternative exists<\/h2>\n    <p>Providers such as <strong>INFOMANIAK<\/strong> offer a 100% Swiss cloud infrastructure, operated by companies incorporated under Swiss law. This means:<\/p>\n    <p>\u2192 Your data is hosted in Switzerland<br>\u2192 The legal entity is Swiss (no CLOUD Act)<br>\u2192 Native nLPD compliance<br>\u2192 No cross-border data transfer<\/p>\n    <div class=\"key-message\">\n      <div class=\"key-message-label\">Our approach<\/div>\n      <p>At Wiven, all our AI agents are deployed exclusively on Swiss infrastructure. And with the rise of AI in business, this issue is becoming critical.<\/p>\n    <p>Don&#039;t let ease of use mask a real legal risk.
